1. Definitions
"Commission" means an order for one or more pieces of furniture or related services placed with Glintora and confirmed by deposit. "Quote" means the written specification and price issued by Glintora prior to a commission. "Specification" means the technical description of materials, dimensions, fabrics and finishes attached to a quote. "Estimated delivery date" means the calendar date communicated to you in the quote or in subsequent written updates.
2. Quoting and acceptance
A quote remains valid for thirty days from its date of issue, after which we may reissue it with revised pricing. A commission is created when you confirm the quote in writing and pay the deposit set out below. Subsequent variations to the specification require both parties' written agreement and may give rise to a revised quote.
3. Deposit and payment terms
- Standard residential commissions — fifty percent (50%) of the total quoted price as a deposit on confirmation of the order; the balance payable on delivery and acceptance.
- Commercial and project commissions — by agreement, typically thirty percent (30%) on order, forty percent (40%) at the half-way production milestone, balance on delivery and signed acceptance.
- Customer's own material (COM) commissions require the material to be received at our studio in good condition before production begins. We do not produce against expected material deliveries.
Payment may be made by Malaysian electronic transfer, cheque drawn on a Malaysian bank, or credit card (subject to a surcharge that reflects the card processing fee). All prices are quoted in Malaysian Ringgit (MYR) and are exclusive of any Sales and Service Tax that may apply.
4. Lead times
Lead times in our quotes are estimates given in good faith based on our workshop schedule at the time of quoting. Standard single-piece commissions are delivered within six to ten weeks of deposit; multi-piece and commercial commissions within twelve to twenty weeks. We will update you weekly on progress and notify you immediately if any material delay arises. Delays caused by events outside our reasonable control (force majeure, supplier disruption, civil unrest, government order) do not give rise to liability on our part, although we will work to mitigate them.
5. Specification variations and substitutions
Where the specification has been signed off, we will not vary materials or dimensions without your written agreement. Where, for reasons of supply, a specified material is not available in the dimensions or quantities required, we will propose a comparable substitute in writing and proceed only with your written approval. Where a substitute is materially different in cost we will refund or invoice the difference at our standard rate.
6. Delivery and acceptance
Delivery within the Klang Valley is included in our quoted price unless stated otherwise. Delivery outside the Klang Valley is quoted at cost on a case-by-case basis. We deliver and install with our own personnel; third-party logistics is used only with your written consent.
On delivery you will be asked to inspect each piece against the specification and to sign an acceptance note. Any visible defects or specification variances should be raised at this point. Concealed defects raised within thirty days of delivery will be remedied free of charge under the warranty in clause 7.
7. Warranty
- Five-year warranty on solid timber frames and structural joinery against manufacturing or material defect, under normal household or commercial use as appropriate to the piece.
- Two-year warranty on springs, webbing and structural fittings.
- One-year warranty on finishes against manufacturing defect; ordinary wear and patina are not defects.
- Fabric and leather carry the warranty of the supplying mill or tannery; full details are provided on your invoice.
The warranty does not cover damage caused by misuse, neglect, accident, exposure to direct sunlight beyond normal residential levels, exposure to liquids, fire, pets, or alteration of the piece by any party other than Glintora.
8. After-care
Residential clients within the Klang Valley receive one annual conditioning visit per piece for the first three years of the piece's life, at no additional cost. After that period, after-care visits are quoted on request. We retain drawings, specifications, fabric records and cushion templates on file for five years from delivery to facilitate any repair or re-cover.
9. Cancellation
Because every commission is built to specification, we are unable to cancel an order once production has begun. If you wish to cancel before production begins (typically within the first ten working days of the deposit), we will refund the deposit less any out-of-pocket expense we have incurred, principally site measurement and design fees. Cancellations after production has begun will forfeit the deposit and any subsequent payments up to the point of cancellation.
10. Limitation of liability
Our total liability to you in respect of any commission shall not exceed the total amount paid by you to us in respect of that commission. We are not liable for indirect, consequential or economic loss. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under Malaysian law.
11. Governing law
These terms are governed by the laws of Malaysia. Any dispute arising under them shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, save that we both agree to attempt mediation through the Malaysian Mediation Centre before commencing any court action.
